Discipline & Appeal Processes — Responding Party: Staff and Faculty

If the Title IX Coordinator or Decision-Maker does not determine that the Responding Party violated the PBIV Policy, the Title IX Coordinator issues written notice of outcome to the Reporting and Responding Parties and provides the Reporting Party with procedures and permissible bases for appeal

  • A party may submit a request for appeal to the Title IX Coordinator in writing within five (5) days of the notice of outcome. Permissible bases for appeal are limited to: (1) procedural error that affected outcome; (2) new evidence that would affect outcome; and (3) conflict of interest or bias
    • The Appeal Administrator (Senior Associate Vice President for Human Resources for staff; Provost and Vice President for Academic Affairs for faculty) determines whether the request includes a permissible basis for appeal
      • If a request for appeal does not include a permissible basis for appeal, the request is denied and the outcome and discipline, if applicable, are final; or
      • If a request for appeal includes a permissible basis for appeal, the Appeal Administrator will consider the appeal and review any relevant materials
        • If the Appeal Administrator determines that the basis for appeal more likely than not had an impact on the outcome, the matter is returned to Title IX Coordinator or Decision-Maker for reconsideration; or
        • If the Appeal Administrator determines that basis for appeal did not have an impact on the outcome, the appeal is denied and the outcome and discipline, if applicable, are final

If the Title IX Coordinator or Decision-Maker determines that the Responding Party violated the PBIV Policy, the Title IX Coordinator refers the matter to the appropriate Vice President (for staff) or Dean (for faculty)

  • The appropriate Vice President or Dean reviews the determination and Investigation Report, as well as any impact and mitigating statements, and the Responding Party's disciplinary record, if applicable, before determining appropriate disciplinary action for the Responding Party
    • The Title IX Coordinator issues written notice of outcome to Reporting and Responding Parties and provides procedures and permissible bases for appeal
